J U D G M E N T
I will
not attempt to reconcile the irreconcilable, that is, evidence
of the Plaintiff with that of the Defendant or vice-versa.
I have before me two completely different versions of how
the collision took place. The issue before me is simple. Who
do I believe?
After having heard and seen the witnesses I accept the evidence
of the Plaintiff in preference to that of the Defendant. The
Defendant has brought a witness, who I have no hesitation
in saying that he is not a witness of truth.
The evidence
of the Plaintiff is corroborated by his action in reporting
the matter to the police and claiming from Defendant soon
after accident.
Judgment
for the Plaintiff in the sum of $2,925.00 and costs.
Counterclaim
dismissed.
